Is CBD Legal In Texas?

Thanks to HB 1325, CBD is now legal in Texas, but that doesn’t mean you can just go buying any product with the word ‘CBD’ on it. Texas still has a variety of rules and regulations regarding the cultivation and sale of CBD products, and still illegal to possess ‘marijuana’, which may also contain CBD. So, what’s legal? CBD in and of itself is legal, and as long as the product being sold contains no more than 0.3% THC, you have nothing to worry about. 

Is Growing Hemp Legal in Texas?

Along with legalizing the use and sale of CBD throughout Texas, House Bill 1325 also opened the door for Texas farmers to begin growing hemp. Based on definitions agreed upon by Texas legislators, hemp is differentiated from marijuana by its THC contents. Cannabis plants with more than 0.3% THC are classified as ‘marijuana’, and those containing less than 0.3% THC are classified as hemp.  Depending on the variety, hemp may contain different levels of CBD, with higher-level strains being used for CBD products, and lower-level strains being used in textiles, industrial materials, etc. Farmers interested in growing hemp in Texas are required to apply via the Department of Agriculture and must follow strict guidelines regarding sourcing seeds, crop yields, and following mandatory hemp THC content guidelines. Remember, to be considered hemp and not marijuana, the plant’s THC content must be below 0.3%.

Is CBD Oil Legal in Texas?

CBD oil is legal throughout the state of Texas as long as it does not contain more than the maximum of 0.3% THC. Exceptions to this rule may be granted to medical marijuana patients who are permitted to possess CBD oil containing up to 0.5% THC.

Is There a Limit To How Much CBD You Can Buy?

Because CBD does not have the same psychoactive properties like THC, many states have few or no restrictions regarding how much a single individual can purchase at a time. Texas is no different, and nothing is stopping you from buying or ordering as much CBD as you want in Texas as long as it meets the state’s strict THC laws. 

Will CBD Show Up On a Drug Test?

Unlike THC, CBD does not have psychoactive or ‘intoxicating’ effects, making it safe for use as a daily supplement; some people even give it to their pets, since CBD has lots of therapeutic value. Because CBD does not leave users feeling intoxicated, standard drug tests do not screen for CBD specifically. If you need to pass a drug test and are confident in the source of your CBD (meaning you know it contains less than 0.3% THC), you should have no trouble passing. If, however, your CBD contains more THC than you think, you could fail inadvertently. In general, it is highly unusual for CBD products to trigger a drug test, so CBD users shouldn’t worry about it being detected.
